ALLEN AND CARON OBTAIN DISMISSAL OF “MONELL” CLAIMS IN AN UNLAWFUL DETENTION CASE

On March 8, 2018, Mike Allen and Scott Caron successfully obtained summary adjudication in favor of the County of Los Angeles in Garcia v. County of Los Angeles. Plaintiff was mistakenly detained by an outside law enforcement agency based on an LA County warrant that matched Plaintiff’s name and birth date, but differed in other respects. Plaintiff was held in custody by the outside agency for several days before being transferred into the custody of LA County where he was briefly detained, brought to court within 48 hours, and determined to not be the person identified on the warrant. Plaintiff sued both the outside law enforcement agency as well as the County alleging, among other things, that LA County had a practice of “deliberate indifference” with respect to handling warrants, and that practice lead to repeated unlawful arrests by law enforcement agencies. The Court granted summary adjudication as to the Plaintiff’s Section 1983 claims against the County of Los Angeles, which significantly limited the remaining claims against the County.
